"Keeping in view the [Afghan] national interests, we – the Afghan refugee ulema and scholars in Khyber Pakhtunkhwa province [of Pakistan] – discussed in detail the ongoing critical and sensitive situation of Afghanistan in the light of the sacred sharia of [Prophet] Muhammad, Peace Be Upon Him, and reached the following conclusion:
"1. We will continue the ongoing lawful and sacred jihad for the freedom of the occupied Afghanistan until the last occupying soldier leaves the sacred soil of Afghanistan, the occupation of Afghanistan is formally ended, and an Islamic government is installed on this holy soil. Allah says: 'And fight them until there is no persecution and religion is wholly for Allah. But if they desist, then surely Allah is watchful of what they do.' (Chapter Al-Anfal, Verse 39)
"2. Allah Almighty has forbidden Muslims from friendship with infidels and accepting any kind of their rule. Those making friendship with them have been declared hypocrites. Allah Almighty says: 'Give to the hypocrites the tidings that for them is a grievous punishment. Those who take disbelievers for friends rather than believers, do they seek honor at their hands? Then let them remember that all honor belongs to Allah.' (Chapter Al-Nisa, Verses138, 139). In another verse [Allah Almighty] says: 'And Allah will not grant the disbelievers a way to prevail against the believers.' (Chapter Al-Nisa: Verse 141)."
"The Short-Term and Permanent Presence of the Occupying Infidels Under Any Title and Name in Afghanistan is Unlawful and Un-Islamic"
"The short-term and permanent presence of the occupying infidels under any title and name in Afghanistan is unlawful and un-Islamic. Any individual or gathering finding ways – collectively or individually – for the occupying infidel forces in Afghanistan and making decision for their stay is acting against the Shari'a and is a blow to the national honor, prestige and national status of Afghans. Such calamitous groups and individuals are liable to be handed Islamic punishment.
"The unholy gathering held in Kabul under the title of Loya Jirga [on November 16-19, 2011] was the best example of such un-Islamic and non-national dirty acts. Incited by foreign aggressors, they took very bad advantage of the Afghans' traditional Loya Jirga and attempted to find a lawful way for occupying aggressors and making the immoral decision of allowing them [the United States] to set up [permanent] military bases. They invited Allah's curse and the rage of the mujahideen and the Afghan nation… Allah Willing! They and their foreign aggressors will soon drown in these storming waves.
"We, the Afghan refugee ulema scholars, term this dirty Loya Jirga – formed by some known former dreaded communists whose nationality is not known, a few deviated ex-jihadi leaders, and some known people, and who endorsed military bases and installations for occupying foreign forces in Afghanistan – as being against the Shari'a, and the national interests and esteem of Afghanistan.
"We call on the mujahid nation of Afghanistan to ignore and disown the decisions of the Loya Jirga that are against Shari'a and are un-Islamic and illegal. Those who support the decisions of the Loya Jirga are considered guilty before Allah and Shari'a."
"You must Realize that the Sacred Jihad and Uprising by the Mujahid Nation of Afghanistan is Based on Belief, has a Religious and National Status, and is Intensifying with Each Passing Day"
"3. We tell the occupying forces that you will get tired of killing us but we will not get exhausted of death and martyrdom because we believe both martyrdom and your defeat is our victory. Allah Almighty says: 'Say, you do not await for us anything except one of the two good things; while as regards you, we await that Allah will afflict you with a punishment either from Himself or at our hands. Wait then; we also are waiting with you.' (Chapter Al-Taubah, Verse 53.).
"Taking advantage of your [American] 10-year-old cruel, dirty, and failed experience and presence [in Afghanistan], you need to immediately leave our sacred land and stop killing more Afghans, destroying public welfare installations, and looting public resources to avoid heavy losses of lives and property. You must realize that the sacred Jihad and uprising by the mujahid nation of Afghanistan is based on belief, has a religious and national status, and is intensifying with each passing day. The spirit of jihad and martyrdom is also affecting our children.
"So, none of you and your puppets' ploy and conspiracy under the title of Loya Jirga or any other pretext can pave way for your short and long-term presence. It will be good for you to pack up [and leave] our country, accept your shameful defeat, seek apology from the mujahid nation of Afghanistan, and get ready for establishing dignified bilateral political treatment and relations based on equality. Don't be deceived by your unbreakable coalition, as you believe, and your unmatched technology because Allah Almighty says 'The hosts shall soon be routed and will turn their backs in flight.' (Chapter Al-Qamar, Verse 45.)"
