Pakistani Jihadist Weekly Examines the Islamic Status of Kashmir, Says: "Kudos to the Muslims of Kashmir that in Contrast to the Muslim Conquerors, They Never Welcomed Infidels on the Land of Kashmir"

In a recent article, Haftroza Al-Qalam, an Urdu-language jihadist weekly published from Pakistan, examined the Islamic status of Jammu & Kashmir. Haftroza Al-Qalam owes its allegiance to the Al-Qaeda-linked jihadist organization Jaish-e-Muhammad led by underground terrorist commander Maulana Masood Azhar.

The article is published amid protests by stone-throwing youth in India’s Jammu & Kashmir state against human rights violations by Indian security forces. Jammu & Kashmir is divided by a Line of Control between India and Pakistan, with the Pakistani part known as Azad (Free) Jammu & Kashmir. In the Indian Kashmir, scores of Kashmiri youth have been killed in the recent protests that began in June.

In 1947 when the British rule ended, the Muslim-majority Jammu & Kashmir was a princely state ruled by Hindu king, Hari Singh. Pakistan sent its army irregulars to wage jihad against the Hindu king who, faced with defeat, signed an instrument of accession to India. Pakistan continues to occupy a third of Kashmir to this day. At the time of accession, India promised a UN-supervised plebiscite, but Pakistan, which was seen as an aggressor state by the Kashmiris, was reluctant of a referendum and did not withdraw its troops as per the UN agreement on a plebiscite. India too later backtracked on its plebiscite promise.

The Haftroza Al-Qalam article, titled "The Background of the Kashmiri Movement and its Islamic Legal Position," traces the history of Islamic rule in Kashmir, arguing that Kashmiris have always sought the help of foreign Muslim rulers in order to protect their Islamic identity. The article is written by Mufti Muhammad Asghar Khan. A Mufti is an Islamic scholar who is qualified to issue fatwas (Islamic decrees).

Following are some excerpts from the article:[1]

"Till Yesterday, the Jihad in Kashmir was Religiously Lawful [in Pakistan]; What Happened That the Fatwas are Being Changed…"

"Kashmiri lions have woken up. From Srinagar to Kupwara, the entire valley is vibrating with the slogans: ‘Allah-o-Akbar’; ‘What do we want? – Azadi [freedom].’

"Youth with stones in their hands and innocent children are face to face with the army and the police clothed in armored vehicles. Stones are being answered with bullets and teargas shells.

"After every few hours, a youth falls dead or someone gets injured drenched in blood… Inhuman violence continues openly along with oppressive crackdown. People are being killed in houses; and veil and four-walled houses are desecrated. Jails and torture cells have been filled.

"But, theKashmiri lions are not ready to bow down, or get pressured or sold. The youth says, now this movement will not be stopped; either Indian rule will end or they would… [unclear].

"Secular and democratic Indian government has instituted a curfew and the media is under their control. Neither complete news nor the true picture might come out. Still, the zeal of [the] movement is not fading.

"And we. Pakistanis are passing through deplorable a situation. News from Kashmir has been suppressed by news about politics and the sinking economy [of Pakistan]. The cries of oppressed Kashmiris have drowned in protocols and noise of talks.

"And our sympathy and love for the Kashmiris have been sacrificed on the issue of our daily bread. Why doesn’t the pain of these Kashmiris make us restless? [They] who have been part and parcel of our nation till recently. Why don’t the dying throbs of the Kashmiris, whose heart beats with us, create any storm in us now?

"Till yesterday, the jihad in Kashmir was religiously lawful, what happened that the fatwas [religious decrees] are being changed? Till yesterday Kashmir was our jugular vein; why has it become a spare vein [now]?

"Why doesn’t this piercing question create any storm in our emotions? Are we all dead or have we forgotten everything?"

"So Far as the Light of Islam is Concerned, It… [Began to Shine] on the Land of Kashmir in 800 AD… [and] the Plant of Islam Took the Shape of a Healthy… Tree in 1325"

"Let me remind what a long period of time Kashmir has been an Islamic state; and let me show that it has not forsaken its right… to have the status of an Islamic state and not be a part of a Hindu state. [I] hope the journey from past to the present might remind you [of] something and might fix your memory.

"So far as the light of Islam is concerned, it… [began to shine] on the land of Kashmir in 800 AD… [and] the plant of Islam took the shape of a healthy and big tree in 1325 when the king of Kashmir, Raja Rinchan, embraced Islam with his family in a gathering on the hands of [Sufi mystic] Hazrat Sharfuddin due to the grace of the secret propagation of Hazrat Shah Meer and the open propagation of Islam by Sharfuddin Abdur Rahman aka Bulbul Shah. Raja Rinchan, after receiving the title of Sadruddin [president of faith] from Hazrat Sharfuddin, protected the honor of that title and ruled with all glory in accordance with Islamic rule until his death in 1337.

"The two years following his death in 1337 were filled with great turmoil because Hindus could not tolerate the beautiful valley of Kashmir being changed into a Muslim state. They strained every nerve [in an effort] to restore Hindu rule in Kashmir, and for a very brief time they were successful. But all of their dreams were shattered when Hazrat Shah Meer, who was working as a minister at that time, courageously took the rein of the kingdom into his own hands and formally established Islamic rule after taking control of the government and started the Hijri calendar in place of Bakri [Vikram/Hindu/Indian] era.[2]

"Hazrat Shah Meer, who later came to be known as Shah Shamsuddin, brought Kashmir under such control in his three-and-a-half year rule that Hindus unable to bring about rebellion. Thus the Shamsuddin dynasty ruled over Kashmir from 1339 to 1561 in accordance with the Islamic system. This house [eventually] lost power partly due to its weaknesses and partly due to the conspiracies of the Chak family who had acquired important positions in the government. The Chak house took control of the government and ruled until 1588.

"The Chak rulers did not bring about change in the system of government. [However, they are responsible for the establishment of] Shi’ite-Sunni bigotry [in Kashmir] because on the one hand Shi’ites were of a narrow-minded nature , and on the other they totally lacked the qualities required for governing despite their being good warriors. That is why eight rulers sat on the throne in quick succession. This situation was extremely intolerable for the Kashmiris who had enjoyed the rule of the Meer dynasty for over two-and-a-quarter centuries. Hence, they [the Kashmiris] sent a delegation of their representatives comprising of Ulema [Islamic scholars] to the court of Mughal Emperor Jalaluddin Akbar [1542-1605], which persuaded Akbar to attack Kashmir and relieve them of the Chak dynasty on the terms that did not compromise religious freedom.[3] Akbar accepted the terms of the delegation and took them into his confidence. He defeated the Chak dynasty by carrying out an attack in 1588, subsequently annexing Kashmir into his kingdom as a separate province."

"The Mughal Rule Started in Kashmir in 1588 And Continued Until 1751"

"Thus, the Mughal rule began in Kashmir in 1588 and continued until 1751. During the Mughal period, Kashmir saw a period of progress and construction. Its glorious reminiscences are still spread in and around Srinagar. There was not only apparent progress and construction, but learning and literature, poetry and recitation, spirituality and mysticism grew strong roots too. And then so happened that with the death [in 1707 of Mughal ruler] Aurangzeb Alamgir that the Mughal empire started declining and because of it its hold on Kashmir weakened, and once again Kashmir was engulfed in the curse of sectarianism and civil war. A local leader, Abul Qasim, declared his sovereignty; but at the same time a prominent sardar (chieftain), Meer Moqeem, met with Ahmad Shah Abdali in Afghanistan urging him to safeguard the Islamic status of Kashmir. Moqeem invited Abdali to attack Kashmir and control it. It should be noted that he was the same Ahmad Shah Abdali who had been invited by [Islamic scholar] Hazrat Shah Waliullah to support the Mughal Empire and suppress the rebelling [the Hindu] Marathas. He accepted Waliullah’s invitation he waged the war of Panipat [near Delhi].

"Ahmad Shah Abdali [the Afghan ruler] accepted the invitation of the Kashmiri delegation and sent his commander-in-chief Abdullah Eishak to attack Kashmir. He conquered Kashmir and made it part of the Islamic kingdom of Afghanistan, which began the Afghani period in Kashmir. Kashmir was made a province in the Afghan kingdom and the caretaker of Kashmir was called Subedar (governor). The Afghan rule remained in Kashmir from 1752 to 1818. This was the time when Sikhs had revolted against the Mughals and had made Punjab their kingdom with Lahore as its capital; and Sikh ruler Raja Ranjeet had carried out all [the necessary] preparations to annex Kashmir.

"On the other hand, the Afghan rulers of later period were a bit more inclined towards rewarding Hindus who had been given many important positions…in Kashmir. This situation was opportune for Raja Ranjeet Singh. Therefore, he began the military campaign. He faced defeat in the first two military expeditions, but then he reached out to some of the courtiers of Abdul Jabbar Khan, the governor of Kashmir, and bought their loyalties by the lure of wealth. In 1819, he attacked Kashmir with full force and, with the help of these people, he wrested Kashmir from the Afghans and annexed it to the Sikh government. Here the dark night of Kashmir began which grew longer and longer and it’s not ending."

"Kashmir Remained a Pure Islamic State From 1339 to 1818 For About More than a Quarter to Five Centuries"

"As you have seen Kashmir remained a pure Islamic state from 1339 to 1818 for about more than a quarter to five centuries, be it the rule of the auspicious period of Shah Meeri dynasty or the rule of Chaks, Mughals or Afghans. And its governing system also remained Islamic; it didn’t matter who was the ruler. You have also seen that whenever Kashmiris found that Islamic status of Kashmir was in danger they invited the outsider Muslim rulers to intervene, keeping aside all their differences. They [the Kashmiris] fully welcomed them [the outside Muslim rulers] till they met decline due to their own deeds.

"In short, the Islamic rule that was established in 1339 in Kashmir became the prey of Sikhs in 1819 and ended. It was a time when all the Mughal provinces met the same fate due to the decline of the Mughal rule.. But, Kudos to the Muslims of Kashmir that in contrast to the Muslim conquerors, they never welcomed infidels on the land of Kashmir. And the Muslims of Kashmir did not sit with ease, nor did they let the infidels live in peace as long as they remained in occupation of Kashmir. You have read above how the Kashmiris embraced the rulers of the Shah Meer dynasty, the Mughals and the Afghans. Now read about the period after 1818 and you will find rebellion, and the slogan of independence and jihad everywhere against the occupation forces.

"Let us view the period after the Islamic rule by dividing it into four periods: (i) Sikh period, (ii) British period, (iii) Dogra period, and (iv) the present Indian government.

"First of all came the period of Sikhs, who brought an end to the Islamic rule which had lasted for about five centuries. We see in the pages of history that they unleashed the reign of terror just after occupying Kashmir. Still they could not suppress the freedom aspirations of the Kashmiris, and that is why after a mere 26 years, in December 1845, after being defeated at the hands of the British, they [Sikhs] rid themselves of Kashmir handing it, including the Hazara division [in present-day Pakistan], over to the British as war compensation. Thus, the Sikh period ended after 26 years, at which point the British period began.

"However, from the very beginning the British felt the… [yearning for] freedom among Kashmiri Muslims and they understood that it would be continuous pain for them to keep Kashmir under the British rule in India, and there would be rebellion in other parts of India as well due to upheaval in Kashmir. Therefore, they decided to get out of Kashmir and to humiliate and avenge the Kashmiris they put Kashmir, including all of its inhabitants, up for auction. Taking advantage of the situation a Dogra jagirdar [Hindu feudal lord] Gulab Singh, son of Kishore Singh, bought the all of Kashmir along with the Hazara district for 750,000 Nanakshahi [the then currency]. Since this deal was made in Amritsar [a town in present-day Indian Punjab], it is remembered as the Amritsar Treaty, or the Amritsar deal. According to this deal, every person in Kashmir became the property of Gulab Singh at the rate of two Rupees per person. Lamenting this deal, the Poet of the East [and Pakistan’s ideological founder], Allama Iqbal, said in the following couplet [in Persian]:

O, the gentle breeze if you pass through Geneva,
Say these words to the League of Nations;
Peasants and their lands, rivers and orchards were sold,
A nation was sold and at what a cheap price was it sold!

"And the gentle breeze might have taken this message of Hazrat Allama to Geneva, the headquarters of the League of Nation, but it would have met the same fate as other Muslim complaints."

"It was the Black Day of March 16, 1846 When the Dogra [Hindu] Period Began in Kashmir; Gulab Singh Took Kashmir as His Property after the Amritsar Treaty"

"It was the black day of March 16, 1846 when the Dogra period began in Kashmir. Gulab Singh took Kashmir as his property after the Amritsar Treaty and attacked Kashmir with his personal troops, but every time he was defeated. At last, once again he prostrated [himself] at the British court after getting tired of his defeats and requested that Mr. [Henry] Lawrence [of the British military] assist in taking control of Kashmir. Mr. Lawrence agreed to help and thus the combined forces of British and Dogras attacked Kashmir. Muslims could not compete with the combined force this time, and the British gave possession of Kashmir to Dogra.

"After the occupation of Kashmir Gulab Singh was established an oppressive government [ruled] leaving no stone unturned to suppress the Kashmiris’ wishes of freedom and revolts. But it is astonishing to note, that during the one century of the Dogra period from 1846 to 1947, the Muslims kept their religious entity and the Muslim-majority status intact in spite of the severest oppressive policies of the Dogras where ‘a Muslim was put into a pan with boiling oil as a punishment for slaughtering a cow and his body was hanged at a public place.’ How sensitive these Kashmiri Muslims have been about their Islamic values and culture? Therefore, they stood up in rebellion at times on the issues of the desecration of the Koran and at times on the issue of Azan [Islamic call for prayer], Juma [Friday weekly] and Eid prayers and the Dogras [were forced] to call for peace forces from the British, especially after the Srinagar incident of 1931 where 23 Muslims were martyred.

"There was such a revolt that even the help from the British could not do much for the Dogras.The slogans for freedom were coming from every corner. It was the time when Syed Ataullah Shah Bukhari [1892-1962], Emir-e-Shari’a, had thrown thousands of activists from [the religious organization] Majlis-e-Ahrar into the Kashmiris’ movement of freedom. The movement became stronger at this time. All of India had been awakened and the movement to gain freedom from the British and the demand for Pakistan was at its height. By the grace of God the announcement of the establishment of Pakistan was made on August 14, 1947; and Kashmiri Muslims had much hope that the establishment of Pakistan, for the ideology on which India was partitioned, favored Kashmir. The Kashmiri Muslims [believed that] the independent states had the right to go with either of the two countries; and Kashmir was a Muslim-majority state and was nearer to Pakistan both geographically and ideologically.

"But Kashmiris realized after the establishment of Pakistan that Dogra ruler Hari Singh was willing to pay any cost to not give freedom to Muslims. At the same time, many of the steps of the Indian government and Lord Mountbatten also hinted at a secret evil alliance composed of Britain, India and Hari Singh, which opposed the freedom of Kashmir.

"Therefore, without losing any time Kashmiri Muslims announced jihad against the Dogra government and began an armed revolt. It was October 1947. At the beginning of the jihad almost all the hilly areas including, Muzaffarabad, Bagh, Poonch, Kotli, Mirpur, and the whole of Gilgit and Baltistan were freed from the Dogras in the very first attack.[4] Meanwhile, in the middle of October thousands of armed Pashtun Mujahideen from the independent tribes of the North Western Frontier Province [now the Khyber Pakhtunkhwa province in Pakistan] reached out to help the Kashmiris. Their arrival changed the whole demography, for now the Pakistan army had also entered into it.

"All of these Mujahadeen, who had occupied the base camp after establishing the Kashmiri government, marched towards the valley with full force. Watching the storm of Mujahideen marching towards Srinagar, Maharaja Hari Singh fled to India and met with Jawaharlal Nehru [the first Prime Minister of India]. After being defeated militarily, he signed an accession treaty with India to make his position strong, at least from a constitutional and legal standpoint. It was against all reasoning and logic and also against the defined partition rule of India. It was a joke for the representative group of the Kashmiri people; the Muslim Conference had already unanimously accepted a resolution in favor of accession to Pakistan three months earlier on July 19, 1947. And on the other hand, the Maharaja was practically dismissed due to the revolt. But these are all moral and legal things and Hindu looters and bruised British deserters had nothing to do with morality.

"[At the UN in 1948] India Accepted Kashmir as Disputed and Also Agreed to Accept the Decision of the Kashmiris through Holding an Independent Plebiscite"

"Therefore, Nehru, who was waiting to usurp Kashmir, took advantage of the situation and accepted the treaty. [He then]… sent the documents to Mountbatten and began preparations to attack Kashmir.[5] Only a day after the treaty, on October 27, 1947, Nehru got his troops land at Srinagar airport and made a full attack. At that time the Mujahideen had advanced beyond Baramulla and there began a formal battle between the Indian forces and Mujahideen. But within two months… [after the] war [began] the Hindus were in great trouble and it became hard for them to retain their occupied territories.

"Frightened by this, India reached [out to the United Nations] Security Council on January 1, 1948, and filed the petition stating: that Kashmiri ruler Raja Hari Singh made a treaty of accession to India; that Pakistan was creating trouble there; and Pakistan should be restrained. Pakistan fought the legal battle in such a fine way that the fabric of the Hari Singh-Nehru Treaty was tattered; and the Security Council accepted Kashmir as disputed territory and it was left to the people of Kashmir to make the decision.

"But sly Nehru, with all his craft, inflicted the defeat for which he had gone to the Security Council; and Pakistan laid the foundation for being cheated. Since, it has been defeated in every talk accordingly. It so happened that India accepted Kashmir as disputed and also agreed to accept the decision [to allow] Kashmiris [to] hold an independent plebiscite. [However this move] succeeded in getting a ceasefire accepted; and it was decided that the ceasefire should immediately be implemented and [only] when the situation improves would he hold the plebiscite under UN supervision. The decision would be made in favor of the majority. Pakistan did not understand the [manipulations of the] sly businessmen and accepted the whole thing. Pakistan declared ceasefire and the Pakistan army retreated.

"The Mujahideen understood the total situation. [They saw that these efforts constituted] a deceit and that the real aim was to give Kashmir to India, which is why they continued their fighting. But a majority in Kashmir had full confidence in the Pakistani leadership and believed that they would be able to get the UN hold the plebiscite in the given time. Therefore, it would be useless to continue the fighting. This mentality also forced the Mujahideen to agree to the ceasefire; and there was a ceasefire. But what was feared... happened… India consolidated its occupation and put the UN resolution in the dustbin, making Kashmir its inseparable part after adding an amendment to its constitution [that declared Kashmir as part of India]. And Pakistan could not dare to declare jihad again against India for not holding the plebiscite in accordance with the UN resolution, [because such an act would have] at least… threatened India of war. Consequently, Kashmir was deprived of the light of freedom and the dark nights grew darker and became longer. And Kashmir said to its fake supporters:

I am in total pain, I’m the valley of Kashmir,
What relation I have with paradise, I’m the fief of oppression;
I’m half-dead, disturbed and a sigh without any effect,
I’m the hunted animal, helpless in the paws of enemies.

"Ultimately, after the end of the deceit and being deceived in 1947, 48 and 49, Kashmir was placed directly under the slavery of the Indian government, having already been enslaved by the Sikhs, English and Dogras. But it went under Indian government [jurisdiction] with a distinction that proves how the situations of Kashmiri Muslims are completely different from those of the millions of other Indian Muslims – who accepted Indian governance and never felt ashamed of being called Indian. The whole world knows, and every inch of Kashmiri land is a proof to the fact, that Kashmiris never accepted Indian slavery and they are declared as rebels against the Indian government."

"[The Afghan Jihad] Brought the Memory of the Early Islamic Era Alive And… Reminded the Kashmiri Muslims that the Real Path to Achieve Freedom… Goes Through Practical Jihad"

"Without caring about the Indian atrocities they [the Kashmiris] have always trampled the Indian flag under their feet and announced before the international media in New Delhi, the Indian capital, that they didn’t accept India and wanted freedom. It so happened that after the jihad of 1947-48 the military front fell a little bit cold and their movement revolved around pressuring India to resolve the issue through plebiscite in accordance with its promise. The Kashmiris did not leave any stone unturned in their efforts. Carrying out processions under Indian bayonets has been a normal thing for Kashmir in which millions of Kashmiris participated. But Indian history is witness to it that India did not pay any attention to these peaceful protests from 1947 to 1988. They kept repeating that Kashmir is the integral part of India.

"And on the other hand the whole world, including Pakistan, remained a mute spectator and none came forward to fulfill its responsibility. But it so happened during the period that Kashmiris remembered their forgotten path like any other victim of the world. Russia attacked Afghanistan in 1979 and retaliating to it Afghani Muslims stood up in such a way that the memories of [Prophet Muhammad’s wars] Badr, Uhad, Hunain, Taif, Qadsia and Yermuk were refreshed in the valleys, hills and woods of Hindukush [mountains of Afghanistan]. Those people who had not put on the goggles of American technology saw the angels of Allah backing the Afghan mujahideen…"

"[The Afghan jihad during the 1980s] brought the memory of early Islamic era alive and became the source of many freedom movements, and reminded the Kashmiri Muslims that the real path to achieve freedom does not go through congregations, processions or the UN, but it goes through practical jihad, which brought glory to Afghans. Therefore, after the Russian withdrawal in 1988, the Kashmiri people retreated to their real path in 1989 and the valley [experienced] the resonance of bullets and bombs along with the meetings and processions. This time the style of jihad was unique; every single person in the community had come [out] into the open in a decisive mood.

"By the Grace of This American Defeat [in Afghanistan Now], the Kashmiri Movement has Yet Again Taken a New Turn"

"On the other hand, India put all [of] its forces towards suppressing this movement. It sent more than 700,000 troops with all the authority [to conduct] inhuman practices in the valley and they used all the mechanisms of oppression and tyranny. But the passion for freedom kept on growing. They [the Kashmiri mujahideen] wrote such a tale of bravery, valor… and support in the hills, dales, cities, villages and towering snow peaks that after centuries the glorious past of the Muslim ummah was restored to memory. On the screen of my memory strange scenes of rejuvenating faith have started passing through, but I’ll touch this note maybe some other time. Let’s take today’s issue.

"It was 2001 when an Indian general accepted in a press conference in Srinagar that there is no military solution to the Kashmir issue; so the Indian government should resolve this issue politically. In military terms this was the open acceptance of defeat by the Indian general and it was the time when Kashmir could have been taken by giving the last blow. But form here started a new story.

"After this acknowledgement of defeat by its general, India reached out to the U.S. and it got the U.S. to pressure [Pakistan’s military ruler] General Pervez Musharraf, who was occupying Pakistan, to declare a ceasefire. After that India got its border secured with iron bars. Thus, it made complete arrangements to throttle the Kashmiri movement through Pakistani rulers. It did not stop with this; it banned the military [i.e. militant] organizations active in Kashmir and the Mujahideen were called terrorists. The permanently perfidious by race, the agents of RAW [India’s external research organization Research & Analysis Wing] made official visits to Pakistan. The result of these conditions was bound to end and weaken the movement. The movement was weakened but kudos to the Kashmiri Muslims that they did not bow to India despite the open treachery of the Pakistani rulers.

"First, [as a result of] the Amarnath Shrine Board issue [the 2008 protests over the state government leasing land for Hindu pilgrims in Kashmir] and then [in reaction to] the issue of the Shopian rape case [allegedly perpetrated by Indian soldiers in 2009, which led to protests], there arose such a storm that all of the Indian conspiracies fell flat and it did not find any time to rejoice.

"Meanwhile, there came a big change on the world map. Musharraf betrayed the Kashmiris too following pressure from the American troops who attacked Afghanistan on the pretext of the World Trade Center [attack]. It got a beating from the Taliban as well. The world was dumbfounded by such incidents carried out by the hands of Mujahideen. The Taliban, with the iron will, not only defeated the Americans but also defeated the minds of American and NATO generals. There isn’t any single general of any country who has not accepted before the media that the Taliban are undefeatable and that we cannot win the Afghan war. India, which had reached Afghanistan to bake its bread on the hot oven with the U.S, and NATO, got such a treatment and its secret network got such a severe blow that all of its dreams were shattered and it cried in the middle of the battlefield.

"By the grace of Allah, the U.S. bowed before the amazing resolution and perseverance of the Afghan Mujahideen [i.e. Taliban] and it has announced to leave Afghanistan by 2011. And by the grace of this American defeat, the Kashmiri movement has yet again taken a new turn and the Afghan victory is directly affecting Kashmir because the movement was weakened only due to the U.S. arrival in Afghanistan. Therefore, Kashmiri Muslims are again resolute on a new journey."

"India Shrieks at the Very Thought of American Retreat From Afghanistan; America had Come to Go; It has to Go; Else It Will Be Dissolved in the Hills of Afghanistan"

"And India shrieks at the very thought of American retreat from Afghanistan. But now these shrieks would remain ineffective for America had come to go. Anyway, it has to go; else it will be dissolved in the hills of Afghanistan. Each of these two situations will blow a new span of life in all the Islamic movements throughout the world and especially Kashmir, whose victory will end the era of their slavery that has spanned a quarter to two centuries. And Kashmir will, Allah willing, become an Islamic state which has been the cradle of Islam for about a quarter to five centuries because Kashmiris are determined to achieve their goal, and they have been fighting for their cause for centuries.

"In fact, I was asked today to write about the Shari’a [legal Islamic] position of the Kashmir jihad but I narrated the past of the oppressed nation for most of those who issue fatwas don’t find time to read the background or do not want to take time out for it. I have saved their time by presenting the background of the Kashmir movement. Now my question is whether there is any need to give reasoning for the Kashmir jihad which is continuing for the attainment of freedom. On what account, is it illegal?

"Let me know whether Muslims should take their rebellion against India back and accept the Hindu slavery by forgetting their glorious Islamic past. Will then it be a thing in accordance with the Islamic law? In my knowledge, it might be according to the laws of Gautama Buddha, Kautaliya or Chanakya, but the laws of Prophet Mohammad, hundred thousand times peace on him, can never agree or allow the slavery of infidels."

"[Pakistan Army’s Spy Agency] ISI Came into Being Long After the Formation of Pakistan While the Kashmir Jihad is Continuing from 1819"

"Some people say that they are not satisfied with the Kashmiri jihad for it is being done on the insinuation of the ISI [the Inter-Services Intelligence of the Pakistani military].

"All praise is to Allah! Don’t these wise people know that the ISI came into being long after the formation of Pakistan while the Kashmir jihad is continuing from 1819 when Ranjeet Singh had wrested Kashmir from Afghans? Which ISI had instigated Kashmiris on jihad at that time? Why was the Emir-e-Shari’a Syed Ataullah Shah Bukhari sending battalions after battalions of the activists against the Dogras? And despite the political differences why did the head of the Sufis [mystics], Shah Ashraf Ali Thanwi, describe this as an act in accordance with religion in his public sermons?

"In short, Kashmir is a Muslim land according to the above mentioned background. Its inhabitants are Muslims, and infidels brought down the Islamic rule there through the use of power; and Muslims want to get that land freed from those infidels who are ‘pure infidels like that of Mecca.’ And they were doing this over a quarter and a hundred years before the ISI was born. And when in 2002, the ISI discontinued their help, they [Kashmiris] did not leave their struggle. ‘Weakening of the movement due to the situation is a natural phenomenon and ups and downs in a movement are but natural.’ Now which of the actions in this regard is against Islamic law? We are not talking about political slogans or ideology; we are talking about religious legal position.

"[To] those who ask us for religious arguments regarding the Kashmiri jihad, I ask them to bring a single argument against it. But the instance should not be based on the foolish comparison of Hazrat Aisha [the wife of Prophet Muhammad] and the daughter of Kashmir; and nor should it be based on any political agenda of any political party. The argument should be in the light of the Koran, Hadith [sayings of the Prophet] and Fiqh [legal Islamic position]. If anyone has any argument, he may bring it to me, and Allah willing, the writer of this piece will appear before him with [the book] Fatah-ul-Jawwad written by his leader [Maulana Masood Azhar of Jaish-e-Muhammad] and then he wjll compare whose argument are in accordance with the Koran, Hadith and Fiqh, and who is making the ummah drink the sugar coated Qadiani poison against jihad [Qadianis =Ahmadi Muslims]?

"Islamic clerics and scholars are well aware of the legality of this issue that waging jihad for upholding the words of Allah is obligatory on a section of Muslims and when infidels start occupying any Muslim city by attacking it, then its safeguard becomes obligatory upon all. And Islamic scholars have a unanimous position on it. In this situation, when jihad is obligatory for a section of people, it becomes legal and when it is obligatory for all it becomes un-Islamic. O’ the slave of Allah, Kashmir is a land which has been grabbed from us and for whose recovery jihad is being waged, which is obligatory on Muslims in all respect, and there is no doubt about its legality insofar as the Islamic position is concerned."

"It has Been 192 Years Since Kashmir Went Under the Infidels’ Occupation But By the Grace of Allah the Islamic Identity is Clearly Seen All Over There"

"Let me talk to the critics of the Kashmir jihad from a different standpoint. One should note it has been 192 years since Kashmir went under the infidels’ occupation but by the grace of Allah the Islamic identity is clearly seen all over there; mosques and mausoleums are thriving and Islamic monuments are in abundance. If not more in comparison to other Islamic countries, they are also not less by the grace of Allah.

"Ponder for a moment. [Woud] there had been this situation in Kashmir if [not for]…the passion for freedom, love for jihad? No and never, a long time ago Kashmir would have become another Andalus whose reminiscent glory Jama Qurtaba [mosque in Spain] has been bearing the Cross for centuries. Forget about mosques and mausoleums thriving [under Indian rule], if the Muslims of Kashmir today leave the path of jihad on the basis of so-called fatwas and accept the Indian slavery; how long will their Islamic identity remain? Would the third generation of Kashmiris not go to the temples by adorning Tilak [Hindu mark on forehead] on their foreheads?

"Please do not cite the example of Indian Muslims who have agreed to the Indian rule, [stating] that they did not become affected [by Indian/Hindu rule]; for those who know the deeper matters, know it very well that their safeguard, whatever it may be, is due to the fire of these Chinars [platane tree]; otherwise the plans that the goons of [Hindu extremist organizations such as] Shiv Sena, Bajrang Dal, RSS [Rashtriya Swayamsevak Sangh] and BJP [Bharatiya Janata Party] have been witnessed by the world in the shape of the demolition of Babri Mosque in Ayodhya [by Hindu extremists in 1992]. However, the demolition of the Babri mosque was just the beginning of their dangerous plan which was chalked out by the goons of the BJP, who had come back after studying the complete eradication of Islam and the Muslims from Spain. But it was [because of] the awe of the Kashmiri Mujahideen that the BJP could not work on their unholy plan even after coming into power and their dream of constructing a Ram Temple [at the site of Babri mosque] could not be realized, although it was a very important part of their election manifesto.

"The recent [Kashmiri] movement since 1990 is a major, extremely popular movement; and now it has come into the hands of enthusiastic youth going out to form the hands of political leadership. Now these youth are of the opinion that they will not accept the decision of political leadership if the movement is stopped before its logical end… [before the] achievement of their goal. Omar Abdullah, the puppet chief minister [of Jammu & Kashmir], the treacherous son of [the] treacherous [father], has openly accepted his failure and the chief of the Indian army says that they have failed to suppress the movement despite an excessive use of power. Kashmiri lions are in the field. They are making huge sacrifices and in this situation, it is our duty to go back to our religious stand and give power to their movement by becoming their hands and arms. It is our test as a religious nation; and future historians are waiting for our decision, as to which path we are going to chose for ourselves."
